UK Implementation of EU Directive 2006/2/EC on Textile Fibres January 2007 (07B-102)
The publication of European Commission Directive 2006/2/EC (amending, for the purposes of its adaptation to technical progress, Annex II to Directive 96/73/EC on certain methods for the quantitative analysis of binary textile fibre mixtures) required all EU Member States to implement national legislation to enforce this Directive by 6 January 2007.
UK Statutory Instrument 2006 No. 3298 has been published and came into force on 6 January 2007.
What is the history of UK legislation relating to determination of fibre composition?
Previous UK Statutory Instruments relating to determination of composition have referred to BS 4407 for the methods of test to be used. However, the latest Statutory Instrument no longer refers to BS 4407, instead it only refers to the test methods published in the actual EU Directives. These Directives are:
1. Directive 96/73/EC of the European Parliament and of the Council on certain methods for quantitative analysis of binary textile fibre mixtures
2. Directive 73/44/EEC on the approximation of the laws of the Member States relating to the quantitative analysis of ternary fibre mixtures.
What does this mean?
After review of methods contained in BS 4407 and 96/73/EC, the EU Directives contain no different or additional procedures to those in BS 4407.
However, to comply with the regulations in the new Statutory Instrument, all test laboratories will need to change their reporting procedures.
Instead of reporting that testing was carried out in accordance with BS 4407:1988, reports will now need to state that testing has been carried out:
“in accordance with 73/44/EEC and 96/73/EC, as amended by 2006/2/EC”
