CPSC Proposes New Rulemaking on Children’s Metal Jewelry

History

In 2005, after initiating one of the largest product recalls in its history, the Consumer Product Safety Commission (CPSC), announced an interim enforcement policy, which involves a two-step testing process, to help manufacturers, distributors, importers and retailers, keep children’s metal jewelry with hazardous levels of lead off store shelves. This process currently uses total lead content as a screening tool but focuses on accessible lead levels as the final safety criteria.

 

Current Action

Acting on a petition filed by the Sierra Club, the CPSC has recently announced it is beginning an Advanced Notice of Proposed Rulemaking (ANPR). The ANPR is an initial step in the regulatory process that could result in a mandatory rule banning children’s metal jewelry containing more than 0.06% lead by weight in metal components. Other alternatives in the ANPR include the labeling of children’s jewelry, the adoption of a voluntary lead standard by the jewelry manufacturing industry, or even adoption of the current interim policy. The ANPR could result in a simplified testing approach, which would eliminate the test for accessible lead and utilize only total lead content as the criteria for determining the safety of children’s jewelry.

The CPSC is seeking comments on the proposals contained in the ANPR as well as any other information or comments from the public and industry. All comments and submissions should be received no later than March 12, 2007. Comments should be e-mailed to cpsc-os@cpsc.gov. Comments should be captioned ‘‘Children’s Jewelry Containing Lead ANPR.’’ Comments may also be mailed, preferably in five copies, to the Office of the Secretary, Consumer Product Safety Commission, Room 502, 4330 East West Highway, Bethesda, Maryland 20814, or delivered to the same address (telephone (301) 504–7923).
