New Requirements in the EU for Toys Intended for Drinking April 2007 (07B-117)
Amendment 10 to EN 71-1 : 1998, incorporated into the consolidated version of EN 71-1 published in 2005, is intended to address the risks of suffocation presented by cup-shaped, bowl-shaped or one-half of an egg-shaped toys having a nearly round, oval, or elliptical opening.
This amendment was introduced to address suffocation hazards for children under 36 months, in cases where these toys are placed over the nose and mouth thereby forming an airtight seal. The associated requirements contain an exemption for toys intended for drinking (e.g., tea set cups).
Following a formal objection from French authorities, the European Commission recently published a Decision1 requiring those toys to now be subjected to an EC Type Examination. In essence, the requirements related to hemispheric-shaped toys need to be applied to these previously exempted toys, with immediate effect.
The CEN/TC 52 standardization committee will most likely remove the exemption from EN 71-1:2005 through an amendment so that these toys are covered by the standard.
