California Assembly Passes Bill to Ban Phthalates in Toys and Childcare Products

The California Assembly has passed a bill to ban certain phthalates in toys and childcare products. The bill now moves to the Senate. If passed by the Senate and signed by the Governor, the law will take effect on January 1, 2009.  AB 1108 is modeled after the recently passed San Francisco Child Product Safety Ordinance.

If enacted into law, AB 1108 would ban the manufacture, sale, or distribution in commerce of toys and child care articles that contain di-(2-ethylhexyl) phthalate (DEHP), dibutyl phthalate (DBP), or benzyl butyl phthalate (BBP), in concentrations exceeding 0.1%, beginning January 1, 2009. 

AB 1108 would also prohibit the use of phthalates in the manufacture, sale, or distribution in commerce of any toy or child care article intended for use by a child under three years of age if the  product can be placed in the child's mouth and it contains diisononyl phthalate (DINP), diisodecyl phthalate (DIDP), or di-n-octyl phthalate (DnOP), in concentrations exceeding 0.1%, beginning January 1, 2009.

California leads the nation in passing legislation to protect children from dangerous chemicals. On September 22, 2006, California signed into law lead restrictions for all jewelry. Patterned on Proposition 65 settlement, the law will cover children’s and adult jewelry, body piercing jewelry, and both metal and non-metallic jewelry components. It will become effective September 1, 2007, for children’s jewelry, and March 1, 2008, for all other jewelry.
