Proposed Norwegian Regulation to Ban 18 Hazardous Substances in Consumer Products

Norway has notified the WTO (World Trade Organization) of its intention to prohibit 18 hazardous substances in consumer products. If adopted, the regulation, known as the Prohibition on Certain Hazardous Substances in Consumer Products (PoHS), will be implemented as an additional chapter in the Norwegian Product Regulations. The Regulation would prohibit producing, importing, exporting or selling of consumer products that contain any of the 18 hazardous substances when the content of the substance in the product's homogeneous component parts is greater or equal to the limiting values specified. The proposal is scheduled to be adopted on the 15 December 2007 and to come into force on 1 January 2008.

Scope
The regulation generally covers all consumer products. A consumer product is defined as any product that is intended for consumers or that can reasonably be expected to be used by consumers. It does not apply to food products, food packaging, fertilizers, medical equipment and tobacco, as well as means of transport, permanently mounted equipment for means of transport and tires and similar accessories for means of transport.

Notes:
 The chemicals listed above are high-priority hazardous substances which are persistent, bioaccumulative and/or toxic, e.g., toxic to reproduction.
