U.S. Proposes Federal Bill Banning Phthalates December 2007 (07B-169)

The U.S. Congress has proposed the Children’s Chemical Risk Reduction Act, that would prohibit the manufacture, sale, or distribution of certain children’s products and childcare articles that contain phthalates. The phthalates restrictions in the federal bill are the same as those established under California’s recently enacted AB 1108, and if passed, would go into effect January 1, 2009. Additionally, a number of states including Massachusetts, Maryland, Maine, and New York have introduced similar legislation.

OVERVIEW OF THE BILL
Definition of “Children’s Products”: Under the proposed legislation, the term “children’s product” means a toy or any other product designed or intended by the manufacturer for use by a child; the term “childcare article” means all products designed or intended by the manufacturer to facilitate sleep, relaxation, or the feeding of children, or to help children with sucking or teething.
Proposed Restrictions A) To prohibit the manufacture, sale, or distribution in commerce of children’s product or childcare article that contains any combination of the following phthalates in concentrations exceeding 0.1%:
di-(2-ethylhexyl) phthalate (DEHP)
dibutyl phthalate (DBP)
benzyl butyl phthalate (BBP)
B) To prohibit the manufacture, sale, or distribution in commerce of children’s product or childcare article intended for use by a child less than three years of age if that product can be placed in the child’s mouth and contains any combination of the following phthalates in concentrations exceeding 0.1%:
di-(2-ethylhexyl) phthalate (DEHP) |
diisononyl phthalate (DINP) |
dibutyl phthalate (DBP) |
diisodecyl phthalate (DIDP) |
benzyl butyl phthalate (BBP) |
di-n-octyl phthalate (DnOP) |
C) To prohibit the alternatives to phthalates which are identified as carcinogens or reproductive toxicants by the Environmental Protection Agency (EPA).
