60 Day Notices for BPA in Sports Bras and Athletic Shirts under California Proposition 65

Recently several brands, retailers and manufacturers received 60 Day Notices for allegedly containing bisphenol A (BPA) in sports bras and athletic shirts which are worn by females and made primarily of polyester and contain some spandex.  

Proposition 65 warning labels for the presence of BPA were not provided with these products when sold.  

The route of exposure for the chemical is dermal absorption directly through the skin when wearing the garments, and ingestion via hand-to-mouth contact after touching or handling the named garments.  

In addition to other uses, BPA and other bisphenols may be used dye-fixing agents for polyester and polyamide textiles.  BPA can also be used in the production of flame retardants and in PVC production. Also, BPA may be used in spandex production for antistatic properties. 

Since there have not been any settlements or judgements in these cases, there is no known reformulation limit at this time for these particular garments.
