California Proposition 65 Settlements

The following is a summary of California Proposition 65 settlements recently finalized that involve consumer products.

Requirements for New Settlements:

Jacket Meant to Protect the Wearer from Rain and Snow

  • Less than 100 ppm (0.01%) of total fluorine, if exceed, further testing conduct for PFOA (BV reporting limit is 0.01 ppm)
  •  Or utilize a warning statement

Note: testing will be performed regardless of claims

Umbrella

  • Less than 100 ppm (0.01%) of total fluorine, if exceed, further testing conduct for PFOA (BV reporting limit is 0.01 ppm)
  • Or utilize a warning statement

Note: testing will be performed regardless of claims

Soft carrying bags, cases and totes

  • Less than 100 ppm (0.01%) of total fluorine, if exceed, further testing conduct for PFOA (BV reporting limit is 0.01 ppm)
  • Or utilize a warning statement

Gift bag

  • No more than 1000 ppm (0.1%) DEHP
  • Warning label cannot be used as an alternative to meet the requirement

Dried mango and mango chips

  • No more than 10 ppb total lead content
  • Or utilize a warning statement

Update current criteria by additional settlements:

Artificial wreaths, Christmas trees and Christmas house garland

  • No more than 100 ppm (0.01%) total lead
  • Warning label cannot be used as an alternative to meet the requirement

Changes: Added scope of Christmas house garland

Cookies and crackers

  • Toffee confection products including wafer, bars: No more than 390 ppb (0.039%) Acrylamide
  • Or utilize a warning statement

Changes: Added requirement for toffee confection products.

Leaf and bagged tea

  • No more than 0.8 μg/L (ppb) lead in infusion sample, or
  • No more than 0.25 mg/kg (ppm) total lead in dried tea
  • Or utilize a warning statement
    Change: Update lead limit with additional settlement
