New Hampshire Enacts PFAS in Products Law

After several significant changes to bill HB1649, New Hampshire has now joined the growing list of states with bans on intentionally added PFAS in certain products.  The bill was signed by the Governor on August 6, 2024.

Requirement Summary and Effective Dates:

  • As of Jan 1, 2027, certain products are prohibited from having intentionally added PFAS including:
    • Carpets or rugs;
    • cosmetics;
    • textile treatments;
    • juvenile products defined as products intended for infants and children under 12 years including but not limited to those listed within the law;
    • feminine hygiene products;
    • food packaging and containers including:
      • unit packaging, an intermediate package, and a shipping container;
      • unsealed receptacles, such as carrying cases, crates, cups, plates, bowls, pails, rigid foil and other trays, wrappers and wrapping films, bags, and tubs; and
      • individual assembled part of a food package, such as any interior or exterior blocking, bracing, cushioning, weatherproofing, exterior strapping, coatings, closures, inks, and labels.
    • upholstered furniture; and
    • textile furnishings including draperies, floor coverings, furnishings, bedding, towels, and tablecloths.
  • Products are exempt if:
    • they are made of at least 85 percent recycled content.
    • they are manufactured prior to the ban.
    • replacement parts made for products manufactured prior to the ban.
    • textile furnishings for medical or industrial settings.
