California Adds Enforcement Body and Registration for Certain PFAS Laws

California Assembly Bill 347 has passed, naming the Department of Toxic Substances Control (DTSC) as the enforcement body for several PFAS related bills. In addition, this creates registration requirements for covered products in compliance with the laws.

Highlights

  • Effective immediately, the definition of juvenile products under the PFAS in juvenile products requirements law (AB652) has been amended to only focus on the listed products. The ‘included but not limited to’ wording has been removed to limit the scope. 
  • DTSC has been named as the enforcement body for the PFAS in apparel and textiles (AB1817), juvenile products (AB 652), and plant-based food packaging (AB1200) laws. 
  • In addition to the existing restrictions on regulated PFAS, on or before July 1, 2029, the manufacturer of covered products shall register with the DTSC and provide the following information:
    • Name and description of each product; 
    • Applicable registration fee; and 
    • A statement of compliance certifying that each product is compliant; 
      • With this, the DTSC may request additional information such as test results and documentation that meets the method and certification requirements published on their site. 
  • Under this new appointment, DTSC shall provide regulations to implement, enforce, interpret, or make specific this chapter and the covered product restrictions on or before January 1, 2029. 
  • They are also required to post on their website acceptable test methods for presence of regulated PFAS and 3rd party accreditations for laboratories by January 1, 2029. 
  • Enforcement and notices of violation under the DTSC would start on or after July 1, 2030.
