CPSC Publishes Final Rule for Crib Mattresses Within Federal Register

On February 15, 2022, the U.S. Consumer Product Safety Commission (CPSC) staff published within the Federal Register the final rules for Crib Mattresses. The final rules will adopt the ASTM F2933-21 standard as mandatory with modifications and will become effective August 15, 2022. 

Background of CPSIA
Section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), requires the United States Consumer Product Safety Commission (Commission or CPSC) to promulgate consumer product safety standards for durable infant or toddler products. These standards are to be ‘‘substantially the same as’’ applicable voluntary standards or more stringent than the voluntary standard if the Commission concludes that more stringent requirements would further reduce the risk of injury associated with the product. 

Summary of Crib Mattress Final Rule
The Final Rule will mandate that all mattresses within the scope of ASTM F2933-21 must meet 16 CFR 1241 Safety Standard for Crib Mattresses. The scope of product includes full-size crib mattresses, non-full-size crib mattresses, and after-market mattresses for play yards and non-full size cribs. 

The Final Rule will also amend 16 CFR 1130 to include crib mattresses as a category of a durable infant or toddler product thereby requiring crib mattresses to be sold with a product registration card. 

The Final Rule, designated as 16 CFR 1241 Safety Standard for Crib Mattresses, will become effective August 15, 2022 and this will apply to crib mattresses manufactured or imported on or after this effective date.  

Summary of Modifications to ASTM F2933-21
• A revision to the definition for conspicuous was made and also a definition for “sleep surface” was added
• Added revised tests for full-size and non-full-size crib mattresses
• Added a general requirement and test method to test the mattress firmness of all mattresses within the scope. The mattress firmness test also includes a dynamic test to inspect for exposed coil springs or metal wires. 
• Added a test mattress sheet to the Mattress Dimensional Measurements for Full-Size Crib Mattresses evaluation and also added a section defining the type of mattress sheet to be used for testing. 
• Made changes to the markings and labeling that is required for product within scope including requirements for retail package labeling
• Added clarifications and figures to assist in testing
