CPSC Publishes Final Rules for Infant Support Cushions within Federal Register

On November 4, 2024, the U.S. Consumer Product Safety Commission (CPSC) staff published within the Federal Register the final rules for Infant Support Cushions. The final rules provide performance safety testing and marking and labeling requirements for Infant Support Cushions and will become effective May 5, 2025.

Background of CPSIA
Section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), requires the United States Consumer Product Safety Commission (Commission or CPSC) to promulgate consumer product safety standards for durable infant or toddler products. These standards are to be ‘‘substantially the same as’’ applicable voluntary standards or more stringent than the voluntary standard if the Commission concludes that more stringent requirements would further reduce the risk of injury associated with the product.

Summary
An Infant Support Cushion is an infant product that is filled with or comprised of resilient material such as foam, fibrous batting, or granular material or with a gel, liquid, or gas, and which is marketed, designed, or
intended to support an infant’s weight or any portion of an infant while reclining or in a supine, prone, or recumbent position. This definition includes any removable covers, or slipcovers, sold on or together with an
infant support cushion.

The final rules, designated as 16 CFR 1243 Safety Standard for Infant Support Cushions, will become effective May 5, 2025 and this will apply to Infant Support Cushions manufactured after the effective date.

Summary of Requirements

  • General requirements include evaluations for hazardous sharp edges or points, small parts, lead in paint, toy accessories, removal of components, and permanency of labels and warnings
  • Performance requirements include evaluations for restraints, seam strength, bounded openings, maximum incline angle, firmness, and sidewall angle.


Marking and Labeling Requirements
All Infant Support Cushions shall comply with the specified requirements for warning statements on the product, packaging, and within the instructional literature.
